What is meant by Naturalisation as a British Citizen?

If you have been granted ILR, indefinite leave to remain in the United Kingdom or Settled Status in the UK, you will be eligible to apply for British Citizenship by Naturalisation. You must be at least 18 years of age to quality by Naturalisation. If you are under 18, the rules to qualify are not the same.

What are the Requirement to qualify for Naturalisation Application as a British Citizen?

In order to qualify for an application for naturalisation after ILR as a British citizen, LR you will need to satisfy and meet the following requirements:

  • You are at least 18 years of age
  • You were and lived in the UK on the day five years before the date of your application
  • You have not been absent from the UK for more than 450 days during the past 5 years
  • You have not been absent from the UK for more than 90 days during the 12 months before the date of your application
  • You have not been in the UK in breach of the Immigration laws
  • You are of Good character
  • You have sufficient knowledge of English test (s)
  • Your intentions are to remain in the UK

Can I quality for British Naturalisation Application if I have not been granted ILR or Settled Status?

If you have not been granted ILR you will not be able to qualify for the naturalisation as a British citizen. You can only apply after being granted indefinite leave to remain, settled status or permanent residence in the UK

What are the requirements on the basis of Marriage to a British citizen?

In order to qualify for an application for naturalisation as a British citizen as a Spouse, you will need to satisfy and meet the following requirements:

  • You are at least 18 years of age
  • You were and resident in the UK on the day three years before the date of your application
  • You have not been absent from the UK for more than 270 days during the past three years
  • You have not been absent from the UK for more than 90 days during the 12 months before the date of your application
  • You have not been in the UK in breach of the Immigration laws
  • You are of Good character
  • You have sufficient knowledge of English test (s)
  • Your intentions is to settled in the UK and make this country your home

Can I retain Dual nationality once I am naturalised?

Yes you can subject to the other country of nationality that you hold. Some countries do not allow dual nationality and therefore it is important to understand once you are naturalised as a British citizen, you will renounce your old one.

Do I need to pay for the Immigration Health Surcharge?

You are not subject to the Immigration Health Surcharge, known as a the UK NHS Surcharge when you apply for naturalisation as a British citizen. The application fee is £1,330. 

Can I apply for British Citizenship straight after ILR?

If you have been granted ILR on the basis of your marriage, you can apply for naturalisation as a British citizen subject to meeting the specified requirements and then apply for a British passport.

How long does the Process Take?

On average it can take between 3-6 months for a Caseworker to reach a decision on your application for naturalisation as a British citizen. You will also be required to conduct a citizenship ceremony post naturalisation.

What happens if my application is refused?

If your application is unsuccessful and is refused by the Home Office, you will not be given a right of appeal to challenge the decision to refuse your application for naturalisation as a British citizen. That said, you will be given the option to challenge the decision by way of Administrative review or submit a new application.
