What is the 7 Years Child ILR Route?
On the 20th June 2022 the Home Office introduced new changes to the Immigration rules allowing children to apply for indefinite leave to remain in the UK on the basis of your private life. The previous rules meant you could only obtain leave to remain for a period of 2 ½ years and then be required to extend your stay in the UK.
Who can apply and does it extend to children born outside the UK?
- If you were born in the UK and have lived in the UK for 7 years continuous since birth you can apply for ILR immediately
- If your child born overseas and has lived in the UK continuously for 7 years you can apply for ILR immediately
- If you were first granted a visa on the basis of your private life when you were aged between 18 and 24, you arrived in the UK as a minor under 18 and have lived in the UK for 5 years continuous with a visa. You can apply for ILR. However, you must meet other eligibility requirements.
Can I include time spent on any other visas?
Yes, provided you had a visa based on your private life for at least one year you can include time spent on any other visa to qualify for indefinite leave to remain.
How long does the Process Take?
On average it can take between 2-4 months for a the Home Office to reach a decision in your application for indefinite leave to remain in the UK. It some cases it can be a lot less and decided quickly.
Which documents are required for me to apply?
The precise documents per case will of course vary in establishing proof of the child’s 7 years continuously residence in the UK, together with your Birth certificate in support of the application. The Home Office will consider your documents and it is important you get the right legal advice to show you meet the relevant criteria to increase your application being granted.
